For those just arriving to the United States, the process for seeking asylum can be incredibly stressful and complex. After leaving a potentially threatening situation, only to be met with the prospect of being sent back can be disheartening. In order to qualify for refugee status or political asylum, an individual must submit the request within the first year of entering the United States while providing evidence showing legitimate cause to fear returning to his or her home country. Furthermore, if the situation within the country of origin has changed significantly (perhaps due to civil war) the individual may apply for political asylum. Some other steps in this process include:

  • Appearing before and interview with a U.S. Citizenship and Immigration Services (USCIS) asylum officer
  • If asylum is not granted, an immigration judge will review the case and additional evidence may be presented
  • Witnesses and other evidence may be brought in to help support the case
  • One year after an individual is granted political asylum or refugee status, that person may then apply for lawful permanent residence by filing Form I-485 (application to register permanent residence or adjust status)
